Christmas Trees

Drenagh Noble Ltd was set up to grow high quality Christmas trees for the UK and European markets. By 2005 we will have 100 acres of Noble Fir planted on our hill farm at Dunbeg, Limavady.

The Noble Fir (ABIES procera) is known as the Rolls Royce of Christmas Trees. They are classic Christmas tree shape, dense, conical with glossy dark green foliage and can be bought from 3ft to 30ft. Unlike many of the other species used as Christmas Trees, it has the ability to hold onto its needles and maintain its colour long after it has been cut.

As Drenagh Noble is involved in the production of quality Christmas Trees the only tree we grow is The Noble Fir. However, as distributors we can source any species of tree, some of those trees are:

Sitka Spruce
Lodgepole Pine
Nordmans Fir

Terms and Conditions of Sale

Prices
Prices are subject to change without prior notification and will be binding when a written order is received. The prices quoted include for delivery anywhere in Northern Ireland assuming a minimum order of 600 trees, unless otherwise arranged. Prices are subject to vat, at the current rate of 17.5%.

Deposits
In all cases a deposit of 20% must accompany each written order unless another arrangement has been agreed upon. This however does not entitle the purchaser to any or part of the order concerned. Except for the return of deposit, no liability will attach to DRENAGH NOBLE LIMITED nor will DRENAGH NOBLE LIMITED be responsible by reason of any delay in the provision of or any inability to provide any trees, whereby delay or inability is the result of weather conditions, act of God, labour problems, delay in transportation by independent carriers or any other causes beyond the control of DRENAGH NOBLE LIMITED.

Payment
Payment should be made in cash or by cheque unless the Purchaser has made a prior arrangement with DRENAGH NOBLE LIMITED to the contrary. Any amounts left unpaid at delivery will be subject to an interest charge of 3% per month. The property and title to the goods shall not pass over to the Purchaser until payment has been made to DRENAGH NOBLE LIMITED in full.

Complaints
On delivery the goods must be thoroughly examined by the Purchaser and any complaints conveyed to DRENAGH NOBLE LIMITED within three days with written details within seven days. Any reduction in the price of the goods due to damage cannot surpass the invoiced price. Any complaints made outside these time periods and DRENAGH NOBLE LIMITED will accept no responsibility or liability.

Reservations
Every order shall be binding upon the Purchaser as soon as written confirmation is received whether it be by post, delivery or fax, subject only to the successful harvesting of the trees. DRENAGH NOBLE LIMITED shall not be liable to the Purchaser for any event or circumstance effecting the successful harvesting of the trees beyond its reasonable control. Examples of such circumstance include fire, disease, vandalism, war or flood.

Liability
DRENAGH NOBLE LIMITED makes every effort to supply the Christmas Trees in good condition and a reliable quality consistent with the standard specified or agreed by DRENAGH NOBLE LIMITED, but DRENAGH NOBLE LIMITED accepts no responsibility for the condition of the Christmas Trees after delivery or receipt of same (except where notification of a complaint as referred above). It is hereby expressly agreed and declared between the Purchaser and DRENAGH NOBLE LIMITED that except as otherwise provided in these Conditions, and except where the Christmas Trees are sold to a person dealing as a consumer within the meaning of Sale of Goods Act, 1979 (as amended by the Sale and Supply of Goods Act 1994) and the Supply of Goods and Services Act 1982 all warranties, conditions or other terms implied by statute, common law or otherwise are hereby expressly excluded. It is further agreed between DRENAGH NOBLE LIMITED and the Purchaser that (save as where otherwise provided in these Conditions) DRENAGH NOBLE LIMITED shall be under no liability whatsoever in respect of any loss, damage, injury or consequential expense or loss arising from any defect in or in relation to the Christmas Trees even where such loss, damage, injury or expense is caused by the negligence or breach of duty by DRENAGH NOBLE LIMITED, its servants or agents. In particular DRENAGH NOBLE LIMITED shall not be responsible for damage to trees for any cause after their arrival at the Purchasers premises. The Purchaser shall be responsible for the unloading of trees at the purchasers premises, DRENAGH NOBLE LIMITED shall not be responsible for any damage incurred in the process of unloading.

Disputes
All disputes arising under this Agreement shall be settled under United Kingdom law and the parties hereto submit to the exclusive jurisdiction of United Kingdom law.
